Use of the deposit: Landlords can benefit from a tenant`s deposit for four (4) general reasons, all or part of the deposit: subletting contract – A tenant who decides to rent land he currently occupies in a lease agreement with the landlord. As a general rule, the tenant must receive written confirmation before authorizing a subtenant. If the tenant rents too late, the landlord can send him a 3-day delay that requires the tenant to pay all the sums earned (including penalties) or to evacuate the property. If the tenant does not do both, the landlord can initiate eviction proceedings. Roommate agreement – Suitable for roommates (living in the same rent) for clearly defining their obligations and duties towards each other. It is imperative that you use the Move In/Move Out checklist in each of your California rental properties and for each rental agreement. The use of the move in the checklist at the beginning of the lease allows the landlord and tenant to note the condition of the property, room by room. After the extract, another inspection is completed, with the owner and tenant noting the condition of each room in the property. A very important document can prove it in court if you have to claim damages on the property or if the damage is part of an eviction procedure. Without the tenant`s signature, you and the tenant do not have contractual documents when the tenant moves in. Landlords should not simply show up at a tenant`s door while waiting to enter the property. Tenants are entitled to what California landlord laws call “silent enjoyment.” If an owner has the entry notification by hand, the owner is able to provide a minimum letter of intent of 24 hours to enter the property, either to inspect the property or to carry out repairs. An exception is made in the event of a major emergency, for example.
B a broken pipe or an electrical or fire hazard. The rent is due on the day indicated in the rental agreement (page 28, owner-tenant manual). California leases allow a residential or commercial landlord to write a legally binding contract with a tenant. The agreement will describe the property, indicate the monthly rent and list all other terms of the parties.
